Should you give the other insurer a recorded statement?

The call sounds routine. It isn't. A recorded statement is evidence, and it can be played back months later.

What the call is for

The other driver's insurer wants facts to decide how much, if anything, to pay. You are not their customer, and you are not required to help them build their side.

How a careless answer happens

“How are you feeling?” “Fine, I guess.” That one answer can come back later as “she said she wasn't hurt.” Many injuries get worse over days, and a recording doesn't remember that you were being polite.

What you can say instead

  • Your name and the date of the crash
  • That you are getting medical care
  • That any other questions should go to your lawyer

Your own insurer is different. Your policy may ask you to cooperate with it, so read what it asks for, and if you are unsure, call us before you answer.
